Welcome to ABC Masonry Ltd. (“Company,” “we,” “us,” or “our”). These Terms & Conditions (“Terms”) govern all services provided by the Company, including but not limited to brickwork, stonework, block construction, repairs, restoration, and related masonry services (collectively, the “Services”).
By engaging our Services, you agree to the following Terms.
1. Estimates & Quotations
All estimates are valid for 30 days unless otherwise stated in writing. Estimates are based on visible site conditions and information provided at the time of inspection.
Additional charges may apply if concealed conditions, structural issues, or unforeseen site circumstances are discovered after work begins. Any such changes will be communicated and approved in writing before proceeding.
2. Scope of Work
The scope of work will be detailed in the written proposal or contract provided by the Company. Any modifications or additions must be agreed upon in writing and may result in additional charges and timeline adjustments.
3. Payment Terms
A deposit of 30% is required prior to commencement of work unless otherwise agreed. The remaining balance is due upon substantial completion of the Services.
Late payments may be subject to interest at a rate of 2% per month (24% annually) or the maximum allowed by law.
4. Scheduling & Delays
Project timelines are estimates only. The Company is not responsible for delays caused by weather conditions, material shortages, supplier delays, permit approvals, or other circumstances beyond our reasonable control.
5. Site Access & Responsibilities
The client agrees to provide clear and safe access to the work area during scheduled work hours. The Company is not responsible for damage to concealed utilities, landscaping, or structures not disclosed prior to commencement of work.
6. Warranty
The Company provides a limited workmanship warranty of 12 months from the date of completion. This warranty does not cover:
- Normal wear and tear
- Damage caused by misuse, neglect, or structural movement
- Acts of nature (e.g., flooding, earthquakes, extreme weather)
- Work altered or repaired by third parties
Warranty claims must be submitted in writing.
7. Limitation of Liability
To the maximum extent permitted by law, the Company’s liability shall be limited to the total amount paid for the Services. Under no circumstances shall the Company be liable for indirect, incidental, or consequential damages.
8. Termination
Either party may terminate the agreement in writing. The client agrees to pay for all work completed and materials ordered up to the date of termination.
9. Governing Law
These Terms shall be governed by and interpreted in accordance with the laws of the Province/State of [Insert Province/State] and the applicable federal laws of [Insert Country].
